Overturning California’s Omnibus Low-NOx Rule

What this does

Using the Congressional Review Act, this resolution voids the Environmental Protection Agency's decision granting California a Clean Air Act waiver of preemption for its Omnibus Low NOX regulation on motor vehicle, engine, and nonroad engine pollution, published at 90 Fed. Reg. 643 on January 6, 2025. The waiver had let California enforce its own low-NOX standards for heavy-duty engines. Once this resolution takes effect, that EPA action has no force or effect. Under the Congressional Review Act, the agency may not reissue it in substantially the same form without new authorization from Congress.
