Nationwide Consumer and Fuel Retailer Choice Act of 2025

What this does

The bill makes year-round sale of E15 gasoline legal and rewrites the Renewable Fuel Standard rules for small refiners. It amends the Clean Air Act so the one-pound Reid Vapor Pressure allowance that now applies to fuel blends with 10 percent ethanol instead applies to blends of 10 to 15 percent ethanol, which lets E15 be sold in summer months when it is currently restricted. States where the vapor pressure limit was applied after a governor's notification submitted between January 1, 2022, and enactment would have that limit lifted for 10 to 15 percent blends. It defines a small refining company as one producing no more than 75,000 barrels per day of obligated fuels in calendar year 2025. Beginning in 2028 the EPA Administrator may no longer grant or enforce small refinery exemption extensions, no refinery may petition for a year after 2027, and no petition may be submitted after July 1, 2028. Also beginning in 2028, the Administrator must cut each small refining company's compliance obligation by 75 percent, and may not reallocate the exempted volumes to other parties. Certain small refineries would get renewable fuel credits from the 2016 to 2018 compliance years returned or reinstated. The EPA must finalize a rule within 18 months modifying E15 fuel dispenser labeling and underground storage tank compatibility requirements. A new hardship exemption lets an at-risk small refinery petition for relief starting in 2028, capped for 2028 at renewable fuel with the energy content of 150 million gallons of conventional biofuel.
