Illegitimate Court Counteraction Act

What this does

Requires the President to impose sanctions on any foreign person who engages in, aids, or materially supports an International Criminal Court effort to investigate, arrest, detain, or prosecute a protected person, beginning within 60 days of enactment and continuing on an ongoing basis. The sanctions are the blocking of all property and property interests in the United States under the International Emergency Economic Powers Act, plus visa ineligibility, inadmissibility, and immediate revocation of any current visa. The visa and entry sanctions also reach the immediate family members, defined as spouse, parent, sibling, or adult child, of a sanctioned person. The bill defines protected person to cover United States persons and the citizens and officials of United States allies that have not consented to ICC jurisdiction, unless the United States formally consents to that jurisdiction and joins the Rome Statute. Separately, it rescinds any funds already appropriated for the ICC and bars any future appropriated funds from being used for the ICC. The President may waive sanctions case-by-case for periods up to 90 days on a written national-security determination reported to Congress, and may terminate sanctions if the ICC ceases and permanently ends its efforts against protected persons. The findings section states that the ICC's Pre-Trial Chamber issued arrest warrants for Israeli officials Benjamin Netanyahu and Yoav Gallant on November 21, 2024.
