Remote Access Security Act

What this does

This bill brings remote access under the same export controls that already govern shipping and transferring sensitive items. It amends the Export Control Reform Act of 2018 so that a foreign person reaching an export-controlled item over a network connection, including the internet or a cloud service, from a location other than where the item physically sits is treated as a controlled activity, on the same footing as an export or an in-country transfer. It defines that remote access and authorizes the Secretary of Commerce to regulate it when the Secretary finds the item's use could pose a serious risk to national security or foreign policy. The bill also directs the Secretary to keep the House Foreign Affairs and Senate Banking Committees fully informed of any planned remote-access rules, in a classified setting when needed, while making clear that those committees' approval is not required before the Secretary acts.
