Made-in-America Defense Act

What this does

This bill directs the Secretary of State, working with the Secretary of Defense, to review the list of defense articles and services that may only be transferred to allies through the government-run foreign military sales program and not through direct commercial sales (the FMS-Only List). The review, due one year after enactment and annually after that, must identify items on the FMS-Only List that could instead be made eligible for direct commercial sale. For each such item it must address how long a transfer takes under foreign military sales versus a direct commercial sale, the workload impact on State and Defense, and the benefits to U.S. national security and competitiveness. Within 30 days of completing each review, the Secretary must report the results to the congressional foreign affairs and armed services committees, including the average transfer times, leading causes of delay, steps taken to reduce delays, and any items added to or removed from the FMS-Only List with justification. The report is unclassified but may include a classified annex. The bill also states Congress's view that faster delivery of defense articles to allies strengthens U.S. security and that the FMS-Only List should be reviewed so items suited to direct commercial sale are not kept on it. It creates the review and reporting duty but does not itself move any item off the list.
