Haiti Economic Lift Program Extension Act

What this does

This bill extends duty-free treatment for imports from Haiti under the Caribbean Basin Economic Recovery Act. It rewrites the termination clause so the preferences run until December 31, 2028. It sets the applicable percentage for qualifying apparel at 60 percent or more on and after December 20, 2017, and caps the preferential treatment at 1.25 percent of the total square meter equivalents of all apparel imported into the United States in the most recent 12-month period. It also strikes the old limit of 16 succeeding one-year periods and replaces it with any succeeding period. The bill orders the President to modify the Harmonized Tariff Schedule to restore eligibility for articles that qualified on December 20, 2006 but later lost eligibility because of tariff schedule revisions, and that proclamation cannot take effect until at least two business days after the President reports to the Senate Finance and House Ways and Means Committees. Because the prior authority had lapsed, the bill applies backward: any Haitian import entered on or after September 30, 2025 and before enactment is reliquidated as if it entered on the enactment date, with no interest paid, and refund requests must reach Customs within 180 days.
