Informing Consumers About Smart Devices Act

What this does

This bill requires manufacturers of certain internet-connected devices to disclose, clearly and conspicuously and before purchase, whether the device contains a camera or microphone. A covered device is an internet-capable consumer product with a camera or microphone. It excludes devices a consumer would reasonably expect to have a camera or microphone, such as phones, laptops, and tablets, devices marketed as cameras, microphones, or telecommunications devices, and certain devices covered by the Communications Act of 1934. A violation is treated as an unfair or deceptive act or practice under the FTC Act, and the Federal Trade Commission enforces the bill with its usual powers and penalties. Within 180 days of enactment the Commission must issue guidance to help manufacturers comply, including best practices for clear, age-appropriate, and pictorial disclosure. Manufacturers may petition for tailored guidance. That guidance confers no rights and does not bind the Commission or any person, and enforcement must allege a specific violation of the Act. The requirement applies to covered devices manufactured more than 180 days after the Commission issues its guidance.
